Critical Areas Ordinance Update Process

The City Council is reviewing proposed updates to the Environmentally Critical Areas Ordinance, formerly called Environmentally Sensitive Areas (LFPMC Chapter 16.16). As required through the Growth Management Act (GMA), our city is required to periodically review and update this chapter to regularly adopt regulations based in best available science (BAS).

The City contracted with consultants, The Watershed Company (TWC) to conduct a gap analysis in order to understand what changes will need to be made in order to be in compliance with the Growth Management Act (GMA). Recommendations from TWC are combined with those from staff, intended to tighten ambiguous language and process have been incorporated into the current Ordinance 1150. Additionally, staff has drafted proposed amendment sheets in response to comments made by the Department of Ecology (DOE) and Washington Department of Fish and Wildlife (WDFW).
