Approved Proposal: Repair and replacement of a side sewer line within the shoreline setback. The repair will take place using the bursting method, therefore no trenching is required. One 4x4 foot hole will be dug to connect the replacement line to the existing line, roughly 30 feet from the ordinary high water line. This proposal is exempt from a shoreline substantial development permit under LFP-SMP 3.3(C)(6)(b). All work must employ best management practices and be consistent with the policies and provisions of LFP Shoreline Master Program and the Shoreline Management Act.

Proposal: To construct a roof over an existing outdoor patio area within the allowable minimum shoreline setback. This requires a variance to the Shoreline Master Program (SMP) because the proposed structure would be located closer to Lake Washington than the SMP allows. The patio would be attached to an existing non-conforming single family home. The applicant has proposed to remove impervious surface, install native plantings, and remove a section of the house and a hot tub structure as mitigation. The proposal, as a whole, would reduce the existing impervious surface area from 87.2% of the lot to a proposed 80.9%, and reduce the building coverage from 36.3% of the lot to 35.98%. An ecological assessment from a qualified biologist found that the project is likely to have a net-positive effect on the shoreline function in the area.

Environmental Review: After review of the proposal and the State Environmental Policy Act (SEPA), the City has determined that the proposal is categorically exempt under WAC 197-11-800 (6) (e). A statement of exemption from SEPA was issued on March 15, 2017. This information is available to the public upon request.

Description of proposal: The applicant requests a reasonable use exception from Lake Forest Park wetland and stream development standards (Municipal Code sections 16.16.320 and 16.16.350) in order to build one single-family house and mitigate the impacts of this construction with enhancement to sensitive areas onsite. The site is zoned RS-20,000 and is currently vacant. The proposed structure and driveway would impact 5,960 square feet of wetland and stream buffer areas. Proposed mitigation includes the enhancement of 3,470 square feet of degraded wetland and 8,450 square feet of wetland buffer. Up to 19 Red Alder and Bigleaf Maple trees may need to be removed, which the applicant would to replace 3:1 with native and conifer trees. A previously approved REU (RU08-02) for the site, to construct one single-family house in a similar footprint, expired in 2012.

Environmental Review: After review of the proposal and the State Environmental Policy Act (SEPA), the City determined that the proposal is categorically exempt under WAC 197-11-800 (6)(a). A statement of exemption from SEPA was issued on March 13, 2017.

Staff Recommendation: Staff recommends approval of the proposal, with conditions. The staff report will be available on the City’s webpage (cityoflfp.com/index.aspx?nid="313)" on or before April 4, 2017.

Description of proposal: Wetland buffer reduction to allow construction of an access road to serve a proposed four-lot short plat, in accordance with LFPMC 16.16.200 (C). The proposed location of the access road is the only feasible means of access to the site. Construction of the roadway will result in the permenant loss of 325 square feet of the degraded buffer area, and temporary modification will occur for 3,219 square feet of the wetland buffer. A pedestrian trail composed of hog fuel and located within the wetland buffer is also included with this proposal, and is allowable according to 16.16.230(F). As mitigation, the permittee will remove invasive plant species and plant native vegetation within 1,236 square feet of wetland, and 28,199 square feet of wetland buffer, including the area that will be temporarily modified. Additionally, the permittee will expand the northeast portion of the buffer by 8,249 square feet for a total area of protected Sensitive Area Tract equal to 72,673 square feet. Native mitigation plantings include 142 trees, 720 shrubs, and 150 wetland emergent species.

Description of proposal: The applicant requests a reasonable use exception from Lake Forest Park wetland and stream development standards (Municipal Code sections 16.16.320 and 16.16.350) in order to build one single-family house and mitigate the impacts of this construction with enhancement to sensitive areas onsite. The site is zoned RS-20,000 and is currently vacant. The proposed structure and driveway would impact 5,960 square feet of wetland and stream buffer areas. Proposed mitigation includes the enhancement of 3,470 square feet of degraded wetland and 8,450 square feet of wetland buffer. Up to 19 Red Alder and Bigleaf Maple trees may need to be removed, which the applicant would to replace with native and conifer trees. A previously approved REU (RU08-02) for the site, to construct one single-family house in a similar footprint, expired in 2012.

Proposal: To construct a roof over an existing outdoor patio area within the allowable minimum shoreline setback. This requires a variance to the Shoreline Master Program (SMP) because the proposed structure would be located closer to Lake Washington that the SMP allows. The patio would be attached to an existing non-conforming single family home. The applicant has proposed to remove impervious surface, install native plantings, and remove a section of the house and a hot tub structure as mitigation. The proposal, as a whole, would reduce the existing impervious surface area from 87.2% of the lot to a proposed 80.9%, and reduce the building coverage from 36.3% of the lot to 35.98%. An ecological assessment from a qualified biologist found that the project is likely to have a net-positive effect on the shoreline function in the area.

Approved Project: A mixed-use project consisting of three stories of wood-framed construction over one story of on-grade concrete-structured parking. Project includes 14 residential units, approximately 600 square feet of office space, and 24 parking spaces. The total site area equals 30,514 square feet and the gross floor area is proposed to be 25,285 square feet. This approval allows the steep slope buffer on the site to be reduced to a minimum distance of 25 feet from the edge of the steep slope, with an additional 15 foot building setback. The proposed building will be built on augured concrete pilings driven into native earth as recommended by the geotechnical engineer. The site storm drainage system has been designed to minimize the impact of the proposed development on the existing drainage system along NE 155th Street. Stormwater generated by the proposed impervious surfaces of the project will be managed via a concrete detention vault under the building that is equipped with Level 3 Flow Control. This flow control standard is the most restrictive provided by the King County Stormwater Design Manual.

Conditions of Approval:
• Soil compaction is required, according to Geo Group NW, Inc. report dated July 9, 2015
• During construction, water must not accumulate in the following areas:
o Any place where building foundations, slabs, or pavements are to be constructed.
o In proximity to the steep slope, nor may the water flow onto the steep slope.
• A geo-tech must be onsite during construction for the following guidance:
o To evaluate suitability of material proposed to be structural fill.
o To monitor the placement and compaction of structural fill.
• Highly visible temporary survey markings shall be installed along the sensitive area boundary.
• After approval by the City, the sensitive area tract must be recorded at the King County Recorder’s Office prior to building permit issuance.

Environmental Review: After review of the proposal and the State Environmental Policy Act (SEPA), the City issued a mitigated Determination of Non-significance (MDNS) on November 17, 2016.

2017 Comprehensive Plan Amendment Application Requirements and Process
The City of Lake Forest Park is accepting formal applications for amendments to the Comprehensive Plan and Future Land Use Map. Amendments to the City of Lake Forest Park Comprehensive Plan are allowed on an annual basis under Lake Forest Park Municipal Code (LFPMC 18.01).

Applications for Comprehensive Plan Amendments, along with the required fee of $500.00, plus $200.00 noticing fee, must be received and determined complete by the Planning Department by 5:00 p.m. on Monday, February 6, 2017. An additional $2,500.00 fee will be required upon acceptance of the proposal onto the final docket adopted by City Council. There is no extra charge for an accompanying rezone proposal. Description of proposal: A mixed-use project consisting of three stories of wood-framed construction over one story of on-grade concrete-structured parking. Project includes 14 residential units, approximately 600 square feet of office space, and 24 parking spaces. The total site area equals 30,514 square feet and the gross floor area is proposed to be 25,285 square feet. The proposed building will be built on augured concrete pilings driven into native earth as recommended by the geotechnical engineer. The site storm drainage system has been designed to minimize the impact of the proposed development on the existing drainage system along NE 155th Street. Stormwater generated by the proposed impervious surfaces of the project will be managed via a concrete detention vault under the building that is equipped with Level 3 Flow Control. This flow control standard is the most restrictive provided by the King County Stormwater Design Manual. The proposed project is located approximately 90 feet east of Bothell Way (SR 522), in Lake Forest Park, Washington.

Withdrawal - SEPA Determination of Non-Significance (mDNS)

Description of proposal: The project proponent (applicant) is proposing to construct a mixed-use project consisting of 4 stories of wood-framed construction over two stories of concrete-structured parking. Project includes 34 apartment units and approximately 700 square feet of office space. The total site area equals 30,514 square feet and the gross floor area is proposed to be 53,517 square feet. A buffer reduction was granted (based on geotechnical, civil engineer, and biologist analysis) to allow the proposed structure to be built no closer than forty feet to the edge of the ravine. The proposed project is located approximately 90 feet east of Bothell Way (SR 522), in Lake Forest Park, Washington.

 

On February 29, 2016 an MDNS was issued for the project. As a result of public comments received after the MDNS was published, City staff conducted additional research into drainage problems downstream from the project location. Newly discovered documents indicate the proposal’s probable significant adverse impact.

The City has withdrawn the MDNS pursuant to WAC 197-11-340(3)(a)(ii), which provides that:

 

“The lead agency shall withdraw a DNS if there is significant new information indicating, or on, a proposal's probable significant adverse environmental impacts”

Notice of SEPA Determination for Commercial Site Development Permit

Proposal: A 5-story mixed-use project to include 4 stories of wood-framed construction over one story of concrete-structured parking at grade. Project includes 16 dwelling units, approximately 500 square feet of office space, and 22 parking stalls. Site area is 8,706 square feet. The proposed project is located approximately 70 feet east of Bothell Way (SR 522). Vehicles will access project site from 35th Avenue NE, at the western end of NE 148th Street. Pedestrian access to Bothell Way NE from this project site will be achieved with new sidewalk construction measuring approximately 430 feet in length, along the west side of 35th Avenue NE and the north side of NE 147th Street (See mitigation measure A below).

The lead agency for this proposal has determined that it does not have a probable significant adverse impact on the environment. An environmental impact statement (EIS) is not required under RCW 43.21C.030(2)(c). This decision was made after review of a completed environmental checklist and other information on file with the lead agency. This information is available to the public upon request. The lead agency for this proposal has also determined that certain mitigation measures are necessary in order to issue a Determination of Non-Significance for this proposal. Failure to comply with the mitigation measures identified hereafter will result in the issuance of a Determination of Significance (DS) for this project. These mitigation measures are in addition to the requirements of City code. This determination does not constitute approval for construction.

The following mitigation measures and conditions are required based on project specific analysis:
A. The applicant is required to provide for the installation of pedestrian access that safely links residents to urban services and community transit on Bothell Way by installing curb, gutter and sidewalk improvements along the west side of 35th Avenue NE and the north side of NE 147th Street to existing sidewalk on NE 147th Street in a manner approved by the City and post security for same. The applicant may also meet this requirement by paying 100% of the estimated cost for the City to install the improvement.

B. Before a certificate of occupancy is issued, a maintenance plan acceptable to the City shall be prepared and recorded with King County addressing landscaping, roadways, parking areas, open space, and other infrastructure owned by the property owners.

This MDNS is issued under 197-11-350; the lead agency will not act on this proposal for 14 days from the date below. There will be additional opportunities to comment on the proposal, however, comments on this determination must be submitted by: May 31, 2016

You may appeal this determination to City Clerk, Evelyn Jahed, at 17425 Ballinger Way NE, Lake Forest Park, WA 98155, no later than June 7, 2016 by written appeal and paying a $500 filing fee. You should be prepared to make specific factual objections in your written appeal.

Conditions:
• Silt fencing inspection is required surrounding construction limits.
• Soil compaction is required, according to Geo Group NW, Inc, report dated July    9, 2015
• During construction, water must not accumulate in the following areas: 
    o Any place where building foundations, slabs, or pavements are to be constructed 
    o In proximity to the steep slope, nor may the water flow onto the steep slope
• A geo-tech must be onsite during construction for the following guidance: 
    o To evaluate suitability of material proposed to be structural fill 
    o To monitor the placement and compaction of structural fill
• Highly visible temporary survey markings shall be installed along boundary and shall remain in place until split-rail fencing is installed along the edge of the buffer, or sensitive area tract.
• Permanent signs are required to mark the boundary between a sensitive area and adjoining land.
• The permittee must apply for and receive approval for all necessary permits from the Department of Planning and Building prior to commencing work on the addition.

• The purpose of CSDP is to establish a comprehensive process to review the land use, design guideline, general infrastructure, and site plan details for proposed commercial or mixed-use site development.
• According to LFPMC 18.46.150 (A), the CSDP shall be decided upon by the code administrator as a Type III administrative decision under LFPMC 16.26.030(C), 16.26.180 and 16.26.190, therefore, a public hearing is not required for this decision.
