Proposal: Relocation of the McKinnon Creek pumping station to an empty lot zoned single-family residential (RS-10) in order to continue providing an adequate level of water service. The new facility is proposed to be built of concrete and masonry construction with metal roof, and will measure up to 24 x 32 feet with a below grade concrete cistern. The proposed design includes a control room and small office upstairs with pumps and pipe gallery proposed to be built below grade, in order to minimize noise to the surrounding area.

The existing pumphouse will be removed from the unopened right-of-way on the eastern bank of McKinnon Creek as part of this proposal. Utilities may be allowed as a conditional use (CU) in residential zones, in accordance with LFPMC 18.54. The site is encumbered with sensitive areas and their buffers; therefore, an exception (PAUE) from the sensitive area regulations is requested with this proposal in accordance with LFPMC 16.16.260.

Approved Project: Reduction of the 50 foot standard steep slope buffer to the minimum allowed 25 foot buffer; and front yard setback reduction from 20 feet to 15 feet for the construction of a single-family residence. Application complies with LFPMC 16.16.310 (buffer reduction) and 16.16.240 (setback reduction) criteria. All work must be completed in accordance with the recommendations of the geotechnical engineer associated with this application.

Conditions:
• Clearing and grading may only occur between the months of April and September.
• Erosion Control BMPs shall be followed at all times.
• No water shall be allowed to collect on or near slopes and no soil or other materials shall be placed on sloping ground.
• Entire residence shall be supported on a deep foundation system consisting of augercast piles terminating into competent undisturbed soils.
• All temporary and final site grading shall be designed to direct water away from foundations and slopes.
• A geotechnical engineer shall be retained to monitor and evaluate conditions in the field throughout site preparation and construction.

Approved Proposal: Replacement of an existing basalt boulder bulkhead roughly 50 feet in length which has eroded and is failing. The proposed replacement will have a rock density of no less than 160 lbs per cubic foot and will be backfilled with 2 to 6 inches of crushed rock. This proposal has been determined to be exempt from the SSD process because replacement is the common method of repair for bulkheads and the bulkhead is located within 10 feet of the primary structure on the property. Proposal: Relocation of the McKinnon Creek pumping station to an empty lot zoned single-family residential (RS-10) in order to continue providing an adequate level of water service. The new facility is proposed to be built of concrete and masonry construction with metal roof, and will measure up to 24 x 32 feet with a below grade concrete cistern. The proposed design includes a control room and small office upstairs with pumps and pipe gallery proposed to be built below grade, in order to minimize noise to the surrounding area.

Utilities may be allowed as a conditional use (CU) in residential zones, in accordance with LFPMC 18.54. The site is encumbered with sensitive areas and their buffers; therefore, an exception (PAUE) from the sensitive area regulations is requested with this proposal in accordance with LFPMC 16.16.260.

Withdrawal - SEPA Determination of Non-Significance (mDNS)

Description of proposal: The project proponent (applicant) is proposing to construct a mixed-use project consisting of 4 stories of wood-framed construction over two stories of concrete-structured parking. Project includes 34 apartment units and approximately 700 square feet of office space. The total site area equals 30,514 square feet and the gross floor area is proposed to be 53,517 square feet. A buffer reduction was granted (based on geotechnical, civil engineer, and biologist analysis) to allow the proposed structure to be built no closer than forty feet to the edge of the ravine. The proposed project is located approximately 90 feet east of Bothell Way (SR 522), in Lake Forest Park, Washington.

 

On February 29, 2016 an MDNS was issued for the project. As a result of public comments received after the MDNS was published, City staff conducted additional research into drainage problems downstream from the project location. Newly discovered documents indicate the proposal’s probable significant adverse impact.

B. Before a certificate of occupancy is issued, a maintenance plan acceptable to the City shall be prepared and recorded with King County addressing landscaping, roadways, parking areas, open space, and other infrastructure owned by the property owners.

Project Description: To excavate approximately 20 cubic yards of sediment at an existing boat launch. The existing concrete boat ramp is 22 feet wide and extends 20 feet waterward, and the entire area proposed to be dredged is 770 square feet.
Native plantings have been proposed as mitigation to enhance the lakeshore habitat.

A Shoreline Conditional Use permit is necessary because dredging is only permitted as a conditional use activity according to the the LFP Shoreline Master Program (LFP-SMP 8.4). The applicant is required to demonstrate that the proposal, including any necessary mitigation, will result in no net loss of shoreline ecological functions.

The proposal made by the applicant to undertake the maintenance activity described above, is exempt from the requirement of a Shoreline Substantial Development permit. Approval for the SSD Exemption request is contingent on Shoreline Conditional Use approval.

The lead agency for this proposal has also determined that certain mitigation measures are necessary in order to issue a Determination of Non-Significance for this proposal. Failure to comply with the mitigation measures identified hereafter will result in the issuance of a Determination of Significance (DS) for this project. Notice of Approval of Buffer Reduction Request - Major Sensitive Area Work Permit

Action: Approval of buffer reductions from existing wetland and steep slopes on this site. Applicant intends to apply for permits to build a single-family house within the remaining buildable area. The approved mitigation proposal includes planting 8,526 square feet of enhancement and protection of the retained sensitive area buffers. The existing driveway is situated within the wetland buffer and the permitee is allowed to continue this use as a crossing. Annual monitoring required for 5 years.

Conditions: 
    • The use of herbicides, fertilizers, and pesticides in stream buffer is prohibited. 
    • All new buildings or structures shall have a setback of at least 15 feet from any place on the edge of a sensitive area buffer. 
    • Before work commences, the applicant shall mark the property with permanent survey markings, and stakes delineating the boundary between sensitive areas and adjoining areas shall be set, as established by current survey standards. 
    • Highly visible temporary survey markings shall be installed along boundary and shall remain in place until split-rail fencing is installed along the edge of the buffer, or sensitive area tract. 
    • Permanent signs are required to mark the boundary between a sensitive area and adjoining land. 
    • Applicant shall record sensitive area tract prior to occupancy and final inspection.

Notice of Application and Public Hearing - Zoning Variance 2015-VAR-0002

This Public Hearing has been postponed at the request of the applicant.
No new hearing date has been established. Once a new hearing date is established, a new Notice of Hearing will be posted to replace this one.

Application has been made by Louise Wright on behalf of Francesco Crocenzi and Amy Bohutinsky to the City of Lake Forest Park for a Zoning variance (File No. 2015-VAR-0002) at the following location:

The applicant requests relief from the required the front building setback, side building setbacks, maximum lot coverage ratio, and maximum impervious ratio to build a two-story addition on an existing house. The existing house encroaches 4 feet into the front yard setback and exceeds the maximum impervious surface ratio by 3%. The garage addition will encroach an additional 2 feet into the 20 feet front yard setback for a distance of 14 feet to the front property line. The addition will increase lot coverage by 40 square feet, to exceed the maximum allowable by 27 square feet. The existing impervious surface area exceeds the 45% maximum allowable and the addition will increase the non-conformity by .06%. Side yard setbacks for the existing structure are non-conforming. The applicant proposes to construct a second story above the existing footprint, which has a total combined side yard setback of 10 feet, with 5 feet on each side. The variance is is needed because the lot is small, has frontage on Lake Washington, and there is not sufficient room in the backyard to construct an addition.

The application was submitted on October 1, 2015 and was determined to be complete by October 29, 2015. After review of the proposal and the State Environmental Policy Act (SEPA), the City determined that the proposal is categorically exempt under WAC 197-11-800 (2) (f). A statement of exemption from SEPA was issued on December 10, 2015. 

The Hearing Examiner will hold the public hearing for this variance application on Wednesday, January 13, 2015 at 10:00 A.M. The hearing will be held at the Lake Forest Park City Hall, which is located at 17425 Ballinger Way NE, Lake Forest Park, WA 98155.

Interested parties are encouraged to comment on the variance application. Written comments in response to this notice must be submitted by the close of the hearing. At this time, the Planning Department is recommending approval of the variance request with conditions. If the Hearing Examiner approves this request, the applicant will be required to apply for all applicable permits through the Lake Forest Park Department of Planning and Building.

Public Notice - 2016 Comprehensive Plan Amendment Application Requirements and Process

The City of Lake Forest Park is accepting formal applications for amendments to the Comprehensive Plan and Future Land Use Map. Amendments to the City of Lake Forest Park Comprehensive Plan are allowed on an annual basis under Lake Forest Park Municipal Code (LFPMC 18.01).

Applications for Comprehensive Plan Amendments, along with the required fee of $500.00, plus $200.00 noticing fee, must be received and determined complete by the Planning Department by 5:00 p.m. on Friday, February 1, 2016. An additional $2,500.00 fee will be required upon acceptance of the proposal onto the final docket adopted by City Council. There is no extra charge for an accompanying rezone proposal.
