You may be eligible to enter a probationary period and have a violation deferred (Deferred Finding).
Deferred Finding defined: You admit to committing the violation, have not had a deferred finding in the past 7 years, agree to enter into a 12 month probationary period and pay a $150 administrative fee within 30 days of entry. Deferred findings may be entered separately for moving and non-moving violations. Failure to comply with the terms of probation for deferred findings will result in notice to DOL of the violation and immediate payment in full of the original penalty amount above and beyond the administrative fee.
Proof of valid license, insurance or registration is required if the charge is related to one of these infractions.
Failure to pay as promised, or to meet a payment schedule worked out with the court, or to comply with terms and conditions imposed by the Court, may result in suspension of your driving privileges, referral to a collection agency and addition of further penalties and/or fees.
You must certify and agree, under penalty of perjury that:
- You committed the infraction(s) listed on the citation. You are asking the Court to defer entry of a finding that you committed the infraction(s).
- You have not had another traffic infraction deferred by any court within seven (7) years of this date, including Teen Court. If your infraction is for the charge of Operating a Motor Vehicle Without Liability Insurance or Expired Vehicle Tabs, I you must appear in order to show the Court proof that you are now insured and have a current registration.
- You do not possess a CDL (Commercial Drivers License) endorsement.
You must agree to the following conditions of your deferral:
- You agree to pay the required Court Administrative Fee of $150 within 30 days.
- The Court will dismiss your infraction(s) one year from the date shown below if you pay the Administrative Fee and if you do not commit a new traffic infraction in any location during this one year period.
- If you fail to pay the Administrative Fee within 30 days of the Courts granting your deferral, or if you commit a new traffic infraction, the Court will, without further notice to you or hearing, enter a finding that you have committed the infraction(s) listed on the citation and will report the finding to the Washington State Department of Licensing (DOL). You will then be required to pay the full original amount of the citation in addition to the Administrative Fee immediately.
- If you have failed to pay the required Court Administrative Fee within 30 days, the Court will assess a $52.00 penalty and notify DOL to begin processing your drivers license for suspension.
