At 7:40 p.m., Mayor Hutchinson recommended that the meeting proceed with informal discussion due to lack of a quorum.

Cmbr. Kiest said he would like to add a report on the Human Services Round Table to the agenda.

Cmbr. Olstad recommended that discussion begin with Ordinance 830/Adopting Sanitary Sewer Fats, Oil and Grease Regulations and other items for which staff is present.

Presentation and Discussion of Ordinance 830/Adopting Sanitary Sewer Fats, Oil and Grease Regulations

City Administrator Jacobson said that Washington Cities Insurance Authority (WCIA) encourages all cities to adopt sanitary sewer regulations regarding fats, oil and grease by ordinance. He noted that the city has not had any claims associated with blocked sewer lines, but WCIA has had claims from other cities.

Jacobson said that the city’s engineer prepared an extensive ordinance dealing with fats, oil and grease regulations similar to ordinances used by cities with sewer treatment plants. Upon review, City Attorney Ruark redrafted the ordinance to fit the needs of the city. Jacobson noted that Shoreline Wastewater Management District has a proactive program and has offered to contract with the city to provide visits, training and follow-up for local businesses.

Jacobson said he would like to place Ordinance 830/Adopting Sanitary Sewer Fats, Oil and Grease Regulations on the September 28 council agenda for second reading.

CALL TO ORDER

Mayor Hutchinson called the meeting to order at 7:55 p.m. following the arrival of Cmbr. Dwight Thompson.

Kiest noted that he will be absent on September 28 and requested that he be excused.

Olstad moved to excuse Cmbr. Kiest’s absence on September 28, 2000. Goss seconded. The motion carried unanimously.

Thompson said he spoke with Cmbr. Armanini who will not be able to attend tonight’s meeting. Thompson moved to excuse Cmbr. Armanini’s absence from tonight’s meeting.

Olstad seconded. The motion carried unanimously.

Right of Way Permit Application Tod Turner

Zenk discussed the application of Tod Turner, 17345 Beach Dr. NE, for improvements to the right of way. He showed photographs of the site and noted that the work has been done. Zenk said the applicant was not aware that the improvements were done to city right of way because other nearby properties had similar improvements. Zenk noted that he plans to approve the permit but brought it to the council’s attention because of its location near the Lyon Creek waterfront property.

In response to questions from Kiest, Zenk said that the improvements do not encroach on the required shy distance. Zenk said requirements regarding maintenance would be stated in the permit.

Cmbr. Sterner entered the meeting at 8 p.m.

Right of Way Permit Application Michael and Catherine Ferrera

Zenk discussed the right of way application of Michael and Catherine Ferrera, 14705 38th Ave. NE, for improvements to the right of way. He showed photographs of the site and noted unique features of the property. In response to questions from Kiest, Zenk discussed how improvements would be made. He said he plans to approve the permit for Michael and Catherine Ferrera.

Discussion of Ordinance 832/Relating to Use of Hearing Examiner

City Attorney Mike Ruark said the draft Ordinance 832/Relating to Use of Hearing Examiner is based on a City of Bainbridge Island ordinance. He noted that this represents changes in policy that require the council’s approval and reviewed various policy issues and choices. Ruark discussed the role of the planning department and the hearing examiner.

In response to questions from Kiest, Ruark discussed the resources that a hearing examiner might use to reach a decision. He suggested that council adopt rules of procedure for the hearing examiner process if council proceeds with adoption of the ordinance.

In response to a question from Thompson, City Planner Ty Peterson discussed options available regarding the decision-making process on subdivision applications. Thompson said he would like the council to be the decision-making body on subdivisions. Goss said it makes more sense for the council to spend its time on policy rather than becoming experts on subdivision applications.

Kiest discussed the use of the consent calendar in the decision-making process by the council. He said the council should remain the decision-making body for environmental impact statement (EIS) appeals (related to Type II applications) as well as subdivisions.

Thompson moved 1) to accept the mayor’s recommendations for changes in the land use permit decision-making process except for Type II applications for subdivisions and EIS appeals (related to Type II applications), and 2) that separate amendments be prepared for council action on Thompson’s recommendation that council remain the decision-making body on subdivisions and on Kiest’s recommendation regarding EIS appeal, and 3) that the Board of Adjustment be repealed on the effective date of the proposed ordinance except for a hearing in process.

Kiest seconded. The motion carried unanimously.

Discussion of Year 2000 Proposed Budget Amendments (Ordinance 833)

Jacobson noted the purpose of the discussion is to determine the use of the funds replacing state-shared revenue and to approve the reclassification of the director of public services position. He reviewed various program costs including marine patrol, 911 call forwarding and city hall janitorial services.

In response to a question from Kiest, Jacobson discussed costs for proposed studies of water and sewer districts.

Jacobson reviewed various office equipment upgrades proposed, and Thompson discussed features and capabilities to consider. In response to a question from Kiest, Jacobson discussed police equipment upgrades and noted that computer equipment would be available for council use.

Jacobson said Ordinance 833/Amending Year 2000 Budget will be scheduled for second reading on the September 28, 2000 council agenda.

A five-minute recess was called from at 9:45 p.m.

The meeting was resumed at 9:50 p.m.

Presentation and Discussion of Proposed Right of Way Franchises

Jacobson said a draft ordinance has been prepared as an example for tonight’s discussion. He noted that such franchises are commonly granted and would allow the city to collect administrative and right of way fees.

Jacobson proposed that potential fees collected could be deposited to street funds to maintain the city’s right of way to current standards.

In response to questions from Goss, Jacobson agreed that the proposal represents income to the city but also may be an added cost for residents.

Jacobson said separate ordinances must be prepared that would be tailored to each utility, and each will be brought to council for approval.

Report Human Services Round Table

Kiest reported on the sunsetting of the Human Services Round Table and the tactical decisions required. He noted that four regional meetings are being planned regarding the plan for a successor entity. Kiest said the cities of Bothell, Kenmore, Lake Forest Park and Shoreline would likely be identified in the north zone and discussed planning for an upcoming meeting.
